MILWAUKEE, Wis (CIVIC MEDIA) – Federal prosecutors reportedly argued against Judge Hannah Dugan’s claim of immunity for her role in helping an undocumented man evade arrest in her courtroom.

Urban Milwaukee first reported that there was a filing from federal prosecutors this week arguing against Judge Dugan’s claim that she’s immune from prosecution. It’s a case accusing her of obstructing an ICE arrest. Prosecutors say her legal team’s arguments stretch judicial immunity too far and ignore that judges can be charged with crimes, even if they step outside their judicial role.

Dugan’s lawyers filed for a case dismissal in late May, claiming that the prosecution of the judge violates the 10th Amendment, which states power not expressly given to the federal government by the U.S. Constitution is then reserved by the states or the people.

A magistrate judge earlier this month recommended the case move forward. U.S. District Judge Lynn Adelman will make the final call on whether the case goes to trial. A date on when a decision might come isn’t known.
