Unveiling U.S. Racial Justice & Voting Rights Challenges

in the history of slavery in this country or chooses to continue to lie. Like when I say, unreal, unreal, unreal. And all the folks following him, you know, some of y'all need to decide if y'all belong to the, to the bed sheet club or if y'all just regular people. Cause the bed sheet club is, is a group of depraved individuals, otherwise known as the Klan.

And many of the things that Trump does that many people in his in his administration has done. You understand clearly that these people have an agenda that harms black people. You understand that it is intentional and by design. You understand that they are disgusting and some haters of black folks, unless you are stepping in fetching it form and serve a purpose for them. When you no longer serve that purpose, they have no use for you.

So we're gonna have that conversation this morning because you know, my weekend was ridiculous. I didn't watch any news. I didn't see anything and so I'm getting caught up early this morning before I come into the show. There were some things I had saw like Friday, but anything that happened on Saturday and Sunday during the day. I missed all of that.

And you know, so it was one after another. Did you see this? Cause I didn't have my phone. I didn't look at my phone most of Saturday evening. So we got to have this conversation, but let me say good morning to the brothers in the building. What up ride out. What up sale? Hey man. Yeah. Right man. You just want to scream. I just can't believe the ignorance of these people. Well, you know, Jesus.

I mean, at this point, I'm not just about to start singing. I love you. I could have with that. That's what it sounds like you was about to do. And I'm going to tell you one more time. But with some of the stuff that's happening in our country, it really seems like a movie, a Saturday night live skit.

just with all of the stuff that's going on. But you know, I'm doing pretty good. It's cold as a fool outside when I woke up this morning. And boy, I was shivering. I was like, man. I had a sweater on at church yesterday. I almost put on a snow suit this morning. I had a sweater on at church yesterday. Man, it was cold as hell. I was like, ah. Said you may not talk it up. Yeah.

But look, it's still too early for your pumpkin latte spice. Your pumpkin spice to latte. Dude, no. Because you can't go in Walgreens. They got the Halloween candy. Jesus said she was it. I don't know what she was, but no hearts. And she said, I think she might have been.

It might have been August, and she already saw Halloween stuff going up. She said, she out in the middle of the store, she said, then what the hell is going on?

We don't give a like seven weeks of summer. Who's God play? I forgot with me and my wife was we see Halloween and Christmas stuff with them. I said

so they can catch the consumers. Oh, yeah. I mean, you know, it's all marketing. You are making that money. Um, oh, no, my Christmas stuff is still in the family. From a year ago. Usually I try to have it down, but like the first week in December, I mean, in January, we try to take it down. LaKeisha's mom passed on January 3rd.

So nothing came down. You know, I mean, like, well, the trees and stuff was down, but nothing got put away. So then slowly I was taking the box down to the basement, you know, being a being and but in reality.

Yeah, I could put all that stuff right back up. So I'm trying to figure out how to skate and just leave it. Until it's time to put it on. You gotta do like everybody else. You gotta go by the seas and just decorate it. Halloween for some more.

You will, you will have my house looking afoot. And I do know some people and I know some of y'all listening. No shame and no shame, but y'all look crazy. Y'all Christmas tree got Easter eggs hanging from it. Y'all look crazy. Clark Kent.

A lot of, listen, I had these turkey tips that right now- Turkey tips? Un-freaking real. What are turkey tips? Listen here, I said the same thing.

There's no tip on the turkey. Just legs, thighs, breasts, wings. What tips? This turkey was a job turkey. What did the turkey tip look like? There are no turkey tips. It looked just like a... Like rib tips? Like rib tips. Un-freaking-real. I can't remember. Turkey tips. Matter of fact, I heard that they'd be in Charlotte, Phoenix, so I'm gonna go check them out.

So I'm gonna check about it. Yeah, was it like press me it was in a square. Yeah, it was in a square like that I know I said press me. Well, no, they actually chop it up and press it together to make it look like a square. They actually have to actually turn off the thing up and made it into like oh, oh, they made it. Oh, okay. Okay. Okay. Okay.

That's like I had turkey meatloaf for whole foods. Yep, cause kids brought whole. So if you've never done whole foods, like a little dinner. So like she'll grab like mashed potatoes, Brussels sprouts and like whatever meat. So she does salmon a lot. Or this time she.

brought home some meatloaf, but I was like, what is this? Because it was all white. It seems like it's meatloaf. I was like, this is not ground beef. What is this? Y'all was eating whale. Did I read the thing? I said, you're going to bring home some turkey. But it's $35 for this outrageous pan of food. If you got to feed your family or if you like single and you want to eat for yourself. Yeah, three, three days.

Man, that's the best $35 you ever spent in your life. And the salmon is always bad. Whole food. Whole food. Whole food. Hey, they cook food and be banging, man. Yeah. I mean, yeah, they cook food is good. And you know, well, I am a Brussels sprouts person now, thanks to Keon, because I would never eat them. But me and Keon went to some steakhouse and they had some with some honey dripped on them.

That was so excellent so But yeah, but we had that turkey below, you know, and actually it wasn't bad But I would never buy It's not for me. Okay, I'm gonna try these turkey change your life. I mean listen, I started doing right

Well, this movie passed him. I had a busy weekend this weekend. I want to thank the good folks over at New Hope Church. Is it Missionary Baptist Church? Yeah, I think it's Missionary. We Roosevelt. Yeah. Yeah. We had the opportunity when I say we, I mean, members of Delta Sigma Theta Sorority.

uh, social action committee members. We had the opportunity to go over to the church and sit out in the vestibule and make sure that folks were registered to vote to give them information on the three upcoming, uh, amendments, constitutional amendments, uh, referendums that are on the ballot to make sure that

folks were informed and educated that they understood what those referendums did. We were actually fortunate enough to have a few minutes to speak to the congregation. And so to Pastor Avi and Pastor Avi, so funny both of them, Pastor Archie Avi, he's the Pastor Emeritus, and then to the younger brother that is now leading

you know, the congregation, Pastor Ivy, Mrs. Ivy, Archie Ivy's wife. I had an opportunity to see her. It was great to see her. And then Debbie Ivy, my sorority sister, who is First Lady at the church now. So it was just great. We saw a ton of people, met a lot of listeners to the show, and had some really great interactions. And I loved that everybody, just about that, we checked at the church. They were good, you could tell.

was being pushed over there. We did, we did have to do one new registration and help a young brother get, get registered. And then there are a couple of people like addresses was off and we're telling people, look, there are folks that have said, you know, I still voted my own address. Y'all cut that out. Y'all cut that out. Y'all cut that out. That is illegal.

That's how we got a sister who was looking at jail time because she was voting at a different address. Yes, I know she passed, but she was voting at a different address. And that is something. And when it comes to, you know, what people consider violations in terms of elections and how folks get handled and prosecuted, it just looks real different for people of color. So I'm telling you right now, if you need to get your registration in order,

in terms of your updating your address information, you can go online and do this. If you need to get your name in order, so you recently got married, or you got divorced, you went back to your maiden name, if you got any issues, and this primarily impacts women, if you got any issues going on with your names, take the time to go get those names in order. But I'm gonna just say this, we have not gone to a church yet in which we didn't end up helping somebody.

We have not gone to a church yet. You know, and every people like, I'm good. I'm registered. I'm straight. We had a sorority sister who came up at a meeting on Saturday and she said, look, I'm asking you to encourage people if you do not.

plan to vote by mail and ballot. You're going to vote in person right up until the day of the election. Please continue to check your voter registration status to make sure that nothing has happened with you being on the rolls. We had two people, they were surprised. They was like, no, I'm registered and I'm turning the screen around and saying that you're not.

So, let's figure out what's going on. Let's just take care of it right now. They went through, they entered all the information they needed to, and then they got the little thing on the screen saying you're registered. So, this election is going to be critical and pivotal, and I just want to say that the church is in good hands over there. I had an opportunity to hear a lot of discernment this morning, you know, and Pastor Meredith, Archie Ivy,

Pastor Ivy he looked good. He looked well and You know, you can you can see the fight you can see the fight is always there and it's beautiful wife So I just want to say how much we appreciate it being able to go over there if you have a church faith group

And you would like us to come out and talk to your group to explain the referendums that's on the ballot to make sure that your folks are registered. They have what they need. Just call me and leave me a message here at the radio station. We will come to Bible study. We will come to church service and sit out in the vestibule and make sure people are good. You know, I laugh. We go back to when we were able to do it at Holy Redeemer.

And Pastor Jeremy was like, let me take care of my stuff. So you just, like I said, it's stuff that you don't think about. But to have the flexibility and the ability to do it right there at church. And when the pastor stand up in that pulpit, you know your congregation is good. Your membership has what they need. So if you are interested, you would like somebody to come out and talk. We brought our information so that people will know the referendums when they see them and what they need. And they will know how to talk about it with other folks. What's it called horseshoe? Yes, went there only to get to the box office area. And they said, oh, the show has been cast. Whoa. And we were like, what? Because earlier in the week, they had sent us something saying the showtime was going to be later than what was originally posted. So we're like, OK, cool. Well, just it's only an hour later. Well, you know, no big deal. And then LaKeisha didn't realize that they had sent it to her. I mean, it went to her spang.

That the show was cancelled so it was people down there dressed clearly had come down for the show and So I don't know what it is with Greg reporter, but I'm not gonna be chasing this man all over the world trying to see him and let me just say For people living a best life. I got a text message. Oh I don't know what night this was was it Friday night Thursday night whatever night it was I got a text message and

It was a picture of the little handsome thing that Jay-Z them uses and it said Jay-Z and I was like what and it was like Paris and I said Are you there? Are we going like what what's going on with Paris? One of my friends was in Paris at the Jay-Z concert She said 75,000 people was in the building She sent me some video from the concert and they were screaming and having a ball and I just

It just made me just look when you have the opportunity to go, go. When you have a chance to live, live. When you get to check something off the bucket list or be spontaneous and take advantage of a moment, please do.

There are so many things around us that are crazy. We're looking at Tom Tiffany and the plane going down, and you saw him become emotional at the mic. Now, I will talk about it later. I got Mark, Attorney Mark Thompson this morning, so I can't do it right now because we're gonna do the scales of justice, but y'all conspiracy people, y'all need to cut it out. It was not to try to give votes. Y'all need to cut. We have become so jaded because it's not our fault. It's not your fault that you have become jaded.

Everybody is still trying to find a scar on Donald Trump's ear. I get it. I get it. To see anyone on this guy. No one. But we will talk about it. I said to y'all all the time, you don't have to leave the country. You don't have to leave the state.

Under our Constitution, you have the right to stand on this sidewalk and film and observe and tell the truth. The Bible says a woman is supposed to dress herself. I agree. But you have women who are pushing back on this idea that women has a subservient role when it comes to men.

Even though they will make public declarations, they will, you know, issue resolutions, they will say whatever they want to. He feels like militarily that there are very few countries that can come up and come for the U.S. And so and on some level, he's right. Unfortunately, on some level, he's right. But people can get us more than militarily.

You know, whether we talk about cyber attacks, infrastructure attacks, there are ways to get us back and to shut us out. We are not invincible as a nation. Right, isn't that isn't that what you do here? That's what we attempt to do cut through all the noise and get to the truth as long as it's not your main talking that's exactly That's exactly what we do Well, it is good to see a lot going on it is so funny the number of times that

Different things will appear and you cross my mind literally. I'm like, huh. I wonder if I should ask about that So it is it is good to have you in house this morning our conversation we were talking about systemic issues and you know, I referenced that there had been a comment made by President

of the United States at the Republican midterm convention. He brought up the issue of reparations and talked about how that, you know, we don't have the money to do that, that they're the people that want it are people that hate this country and that.

They could afford to do 5,000 per person, but they couldn't afford to do anything That would be required for reparations and these were crimes that the people of today didn't commit he did call them crimes but And so you just begin to think about how entrenched certain things are and I talked about the fact that

in October Ava DuVernay who did the 13th project she now has a new project called the 14th and it is actually going to air on Netflix in December and so this morning when you said our conversation will touch on both the 4th and the 14th amendment I'm like okay I'm ready for this conversation so do me a favor mark tee up our conversation this morning you know

So my name is Mark Thompson. My firm is Jingress Thompson and Walks and I've been with this firm's nine years now, but I have been a lawyer since 1987 and For the first year worked at the 7th Circuit

which is the Court of Appeals before the US Supreme Court and sets the law in Wisconsin, Michigan and Illinois and The one thing that I've learned through this lifetime of reading cases and looking at the stories or the facts as we say that give rise to this

there is this wrestling within the courts over what is the fourth amendment and what does it protect and who does it protect and and that you know we talk about you cannot stop someone on the street law enforcement can't stop someone on the street

absent reasonable suspicion of a crime. You can't search without a warrant in the home. This idea of an individual having liberty every day. It's the Fourth Amendment. Fourteenth Amendment is equal protection. And it comes out of the struggle of

the African-American people to find freedom after being treated as property. And so when you say that we have a president who talks about reparations out of slavery for people who don't love the country,

It is so divisive and it's so untrue, right? Because it is the African-American people have been the heart of democracy, the heart of voting rights, and every success and step forward for the African-American people has meant humanity has stepped forward.

And when you have a president that turns the world upside down with a lie, we know we're at this critical point. We've spent a lot of time talking about, right, MAGA's movement, Steve Miller's movement to turn this country into,

a white power country and not a democracy where everyone is treated equally. And so that's sort of the backdrop. Tomorrow I go back to the Southern Circuit and I get to argue on behalf of pastors William and Patterson about why a federal judge here in the Eastern District got it wrong when

the judge dismissed their lawsuit. So this is one of the things that I do that other lawyers in the business, personal injury business, I don't think necessarily do or not as much as we do. So I just want to touch on what happened. May 1st, 2018, think about it. That's like eight years ago. They'd been fishing.

And wait, but can I just do this because I want to just make sure so the community makes this connection So we're talking about the Reverend Demetrius Williams of community Baptist Church of Greater Milwaukee and Reverend John Patterson of Mount Olive Baptist Church So the community will have a point of reference because these are well-known individuals in the community. Yes, they are okay and They've been out fishing

And on their way home, they're driving along I-94 coming back. They're on the Rock River, so they're coming back. And they're in Waukesha County. And unfortunately, a tire on their boat trailer blew out, so they have a flat. And they pulled way over off the road and way onto the shoulder. And as soon as they got there,

Pastor Patterson called his insurance company said we got a flat. They said, you know, we will send out a tow truck. It'll be there very soon enough and so then they were waiting and as they were waiting a Waukesha County Sheriff's vehicle comes up behind them with the lights flashing and

they assumed that this was just sort of a caretaker function, right? Our state troopers, our deputy sheriffs, our police officers, when they see a human being in distress and need, they come to help, right? Serve and protect, right? To serve means to help. And the deputy

walked up to, uh, Pester Patterson's side. He was driving. He did not say hello. He did not say, are you okay? He just said, do you have guns? Do you have drugs? And first thing out of his mouth, first thing out of his mouth.

And Pastor Patterson looked and says, we're fishing and we're pastors. What are you talking about? And they says, give me your driver's license. And he's like, why? Why? And then he demands that Pastor Williams, who's the passenger, give me your driver's license. And Pastor Williams says,

You know, I'm I'm a passenger. Why do you want my license and He walked around the car Got up right up the on the passenger side and and now he's looking at Pastor Williams and he says I Have to have your driver's license. He says why he says it's policy. I have to have

driver's license and Pastor Williams is and Patterson thing look at this thing could completely escalate right and so they turn over his license but under protest and then the deputy goes back to the squad and all this time the lights are on right got the license 15 minutes later

Comes back gives them the drivers put the sticker on the car and drives off, but they ran a warrants check, right? Right they ran the warrants check And so that's a quick question So is that something like when you get my driver's license and you run that Does a warrant automatically show up or when you say ran a warrants check? Is that a second procedure that you have to do? Well, they're running a procedure, right? They're gonna put your name

Your driver's license in to see if there are any outstanding warrants Right. I mean in it, you know, these are these cases all tied together We had a lot of discussions about Isaiah Taylor's case right young 16 year old young african-american running taking a turkey to his neighbors at Christmas Pull them over Because they want to run a warrants check right

So the assumption is that this is not a reasonable sufficient of a crime, but a crime we're going to go get, you know, we're going to go check the warrants check. So we find out it's any warrant and we can make this a rest. The pastors said, look, you know, this isn't right. They work with common ground and they tried to take it to the sheriff and, you know, like let's use this as a teaching moment.

The sheriff Was non responsive In the course of this there was a white woman Susan hero who wrote a letter to the the sheriff and said look I Had the same thing happened to me in Walker Shaw except when the deputy came by they came up and just said hi How are you doing made sure I was okay was cold. Let me sit in their car while

Right and so eventually the passers came to me and I said look we'll file a civil rights case and Let's go through it because this is when an officer comes as a caretaker function They don't have the right to take your license see

If it's a traffic stop, that means they have a reasonable suspicion that you violated the law. Either you were speeding, right, or your license plate wasn't on, or you got tinted windows. So at least there, there's a law, right, that says, creates this reasonable suspicion, even though we, we know how that can play out. But, so here we have this case.

So it's caretaker There was no reason to ask anyone for their license insist on their license when they said why do you have to have them and We filed this lawsuit and we got into it and What we what we learned is that When when this deputy he had said that there was a policy it wasn't true Right because he was trained That if it's a caretaker function

You can't have you can't insist on taking the license and certainly you can't run a once-check and you certainly can't keep anybody there So that his supervisors said whatever story is is just not true Now part of our claim was not only that this violated Fourth Amendment Hang on so we let me take a quick break and then we come back because I went back and pulled a story

And it also looks like that one of the officers was quote in training and there was a supervising officer or we'll get to Yeah, because I'm trying to figure out like so if this is happening and you're being trained But if the share policy is the shares Okay, yeah, so let me take a break cuz I got questions. It actually evolves to local Milwaukee pastors who had been on a fishing trip pulled over by the... I mean, I'm sorry, not pulled over, but they had a tire blowout on their trailer and they're on the side of the road waiting for a tow, walk a shaw, deputies, interact with them, and I will turn it over to Mark so he can...

continue to bring us up to speed on this story, which I'm choking over and burning up under my collar. But go ahead, Mark, please. Fire away with the questions because, you know, the, so we, we have a deputy who comes up and is treating the pastors as if they're criminals or committed some crime, right? Where are the drugs?

You know, wear the guns because there's no acknowledgement that they're stranded on the side of the road with this this flat tire. There's no safety acknowledgement at all the Not in the approach to the deputy right the records that we found out were as they approached they knew the vehicle was completely off the road and this is sort of where the story that

Shifts as the deputy is being investigated You know, but but let's also go back to there was a we sued for racial profiling and a class of one equal protection claim with because this white woman Who happened to be a lawyer said look at this is not how I was treated? Right and so and there are there's case law out there that says where

You're looking at a fourth amendment and their violations of the fourth amendment and that The violations of fourth amendment are linked to One's race race is a factor right and so we asserted that we had enough for a jury to decide violations of the fourth and 14th amendment and What was

really interesting in this is because the training officer first came out and said that the deputy's statement about a policy that he was following policy was not true, right? That the Waukesha Sheriff's Department do not have a policy of insisting that drivers that are in road trouble, right?

Caretaker have to turn over their license Rather the policy is if you ask they can ask for it always, right? But if you say no that then the officer must stop so that the officer should have never taken But this is my first my question. Okay. Go ahead fire away if the training officer You know because for me, it's not just enough for the training officers. I know we never

Told him that there was this kind of policy, but you see this deputy sheriff running these Licenses and you see him take the license from the passenger. So at what point Does the training officer say to this this officer that is in training? What are you doing? and the training Comes up with a story saying there is

Right because then he started changing his story when he got back and he wrote he said The tire was not the boat wasn't completely off the roadway. So now we have He knew enough about the law That he needed to make it a traffic stop not a caretaker function because if it's a traffic stop

if he had reasonable suspicion that the vehicle was on the roadway, not off the roadway, then he can ask for license and then he can run a warrants check. His supervisor that I deposed and up the chain of command said, if they would have known that there were lies in the letter, because when I deposed officer deputy, he said his report.

Was a CYA letter. That's what he said Right good when I because I said to him you knew the vehicle was off the roadway. Yes, so when you wrote in your report that it was on the roadway That was a CYA and he said yes, so we knew he knew the difference Right and we knew that he didn't tell his super of his training officer the difference

I'm still dying officer can see to you you can stay in the car while he's doing all this I want to go I feel I agree with you we took this to the federal judge and the federal judge Three years after all the briefing ruled that the deputy didn't violate any rights and dismissed their

their cases. And this is why I'm going back to Chicago tomorrow. Hang on before we get to Chicago. It took the judge in this case three years to render a decision. Is that what you just said? That's the fact. So, but let me wrestle with.

What is wrong with this? What happened? Like justice delayed justice denied. I mean three years and that's why I said this is related. This is related to mega and mega's lies. Okay, because what we have that judges decision accepted the officers reasoning saying the officer believe

They had a reason to suspect that the vehicle was on the roadway. So they had the right to do, run the license, run the warrants check. And so that decision now becomes the legal infrastructure that sets the example. That's where the law becomes part of the problem.

Right when the law Justifies this kind of conduct that allows Not allows it gives the green light For everybody to continue this conduct so now is it that the law Sets up the situation for this type of conduct because if the law was being applied properly and the I'm just gonna say it and his deputy wasn't lying

then the law would have worked as design. We're going to find out. We always say the laws are only as good as the people who enforce them. Right. We're going to the Seventh Circuit and the Seventh Circuit. We're going to ask the Seventh Circuit. This is happening tomorrow. Seventh Circuit. I'm going to ask the Seventh Circuit tomorrow to reverse the district court's decision because that decision can't be, right? Because and here there are fundamental

when you look at an appeal, right? What a judge can't decide on summary judgment is credibility. And the law says the judge has to assume that the facts that we allege are true. And if it creates factual disputes for a jury, then the jury must do it. But instead, the judge accepted the reasoning of the deputy. Now, that is, in our mind,

illegal error that requires reversal but also stunningly what the what the judge said was that no one would reasonably believe that if a law enforcement officer pulled up behind you with their lights flashing that you couldn't just drive away wait what that's what

the federal judge said. The federal judge didn't cite any case that said it, because everyone knows it's not true. In every state in the Seventh Circuit, if an officer pulls up behind you with their lights flashing, you cannot move. Because if you move, then you're a fleeing felon. Right? So this judge not only

violated the law and in our mind by accepting what the officer said is true as opposed to what the pastor said because that's a jury question but also came at it with a wrong legal theory made up out of the blue that no one in America would accept is true nobody no one so let me just ask this question because now

The key thing is the Seventh Circuit has to reverse this. And that's the question I'm getting ready to pose is, so what kind of timeframe are we on? I mean, if it took three years to get a decision from this judge here in Wisconsin, you go back, you ask the court to consider a reversal, how long does something like that take? Or can it take? That's a very good question. Generally,

a decision from the Seventh Circuit. It's probably six to nine months. It can be a year and a half. I have a case right now that I'm almost at three years waiting for a decision. So there are all sorts of issues with justice in America, right? Not only bias,

Right But I to me the point is and we say it every time Nothing will change unless people stand up and say end it Right if you just are sitting at home thinking it's just gonna get right if I just sit here and keep chewing my bubblegum it ain't happening Okay

If pastors William and Patterson didn't say enough is enough. We wouldn't be here going to the 7th Circuit and say, look, this can't be right. You cannot let. You know, it's the jury decides these things at the end of the day. And also, you know, just to be as far as I'm concerned, just candid and honest about it, having attorneys willing to take these cases.

Because so many times we get phone calls to this radio station, and this is before you and I begin doing this segment. And we tell people, no, take it to it. And the number of people say, no one will take my case. No one will take my case.

I don't know if it's because people can foresee down how long these things can take to process, particularly if it's on contingency. So lawyers are doing all this upfront work and not getting paid. And you're talking about three and five years in, like this is the worst. You know, there is sort of this notion that little harms don't deserve justice, right?

Isaiah Taylor was held in the car five minutes. Everybody said, so what? It's a 16 year old kid, so what? Right? But the seven circuit said, even one second is too long. So we get to cite that in this case, right? They said, what, it's 15 minutes we had there, license we ran a warrant check, so what? Wait a minute. The seven circuit said, one second.

of an unlawful detention is too long. So how do we value that, right? Lawyers, my competitors, people are looking for the, in terms of the business model, and you can see it on civil rights cases. If there's a death, people from all over the country will run in and grab the case and grab the money.

Right, right But if it's two pastors Who were some folks say they were just inconvenienced so what they had a flat tire they weren't going anywhere and as as if Having their license taken as if being asked Are you do you have drugs? Do you have guns be treated like a right? You're suspected of a crime

And you can't go is like so what but you said that's the issue might might one of the reasons you know My dad was a preacher. This would have never happened to my dad, right? It wouldn't happen to you want to happen to me and the the point of this is We have to insist as a people that every human being is treated the same, right?

Susan Hero was the white woman that was treated like a human being. Asked, can we help you? Caretaker function, not treated. And when we get the little things right, right, that will lead to the big things, right? If we have this respect for human rights right up front, then we don't get pulling guns that we're not shooting people.

Our Constitution, you have the right to stand on this sidewalk and film and observe and tell the truth. The Bible says a woman is supposed to adjust herself. I agree. But you have women who are pushing back on this idea that women has a subservient role when it comes to men.

Because the Bible's not the Bible's not telling men how to dress I've never had that problem. But what I'm saying is show me show me the Bible where it says that men should dress modestly. I got it. I have always had it and I got seven sisters and the same and we didn't have to do that and we are all very successful women and we have successful husbands.

even though they will make public declarations, they will, you know, issue resolutions, they will say whatever they want to. He feels like militarily that there are very few countries that can come up and come for the U.S. And so and on some level, he's right. Unfortunately, on some level, he's right. But people can get us more than militarily.

You know, whether we talk about cyber attacks, infrastructure attacks, there are ways to get us back and to shut us out. We are not invincible as a nation. You know what? Whatever, man. You know, you could tell dude thought I was a guy when he pulled up on the car You could tell as soon as he saw my face. He was like, oh, this is a this is a lady But you know how I wear my caps. Yeah, I know how I keep my hair cut and so and then I got hoodies on so you could tell he was shocked when he realized I was a lady and you could tell he was shocked when he realized how old I was and Then you but we all got these stories

And so when you have something like a referendum on the Wisconsin State November 3rd election, where we want to get rid of anything that has to do with diversity, equity is the word I'm just coming for, and inclusion, y'all need to be voting no on that referendum ballot. Truth be told, you need to vote no on all three of them.

But if black folks sit on they behind this election and let these white Republicans Give it pass into the state constitution that you can never take race gender or sex sex into Consider that's the same thing racing gender into consideration For different things that we do with the state Y'all shame on us

And you need organizations like the NAACP and, you know, all these other groups that's out here, they need to be beating the drum every day from now until November 3rd. We are on the ballot. Black people are on the ballot. They are coming for us on this ballot. Tom Tiffany and his people in the Republican Party are coming for black folks on this ballot.

everybody else going to get caught up. But it is intentional. It is intentional and we sitting around and potentially we don't show up and we will have allowed our state constitution to say and be changed that we can never consider race in relationship to a state agency or program if we see some visible disparities.

We know we don't have enough minority apprenticeships. We know we don't have enough minority teachers. We know there's a black infant mortality problem. We know that there are black health disparities. We know that certain things are happening along racial lines that are inequitable in our justice system and we need to, excuse me, we need to review that. But Republicans want to put it on the ballot that you don't get to do that.

Everybody black I know need to get up off they behind and let other black folks in their family know I don't give a damn if you go vote for David Carly or not. You need to show up for that resolution. I mean that our referendum that's on the ballot about diversity equity and inclusion because that is for us to hurt us by them. Let me go to the phone line. You're supposed to honor those flashes on the school buses and any vehicle.

I know truck drivers put their cones and stuff out there, but school buses and other vehicles, you're not supposed to go flying through there. I see them blow stop signs all day long right over here by me, so it's like they don't even see them. But so yeah, Attorney Mark is right. He's right when it's service, care, and stress. I was wondering if he didn't say anything about the flashes being on, but they should have been. But even with that though, the tire.

All right, thank you And you got all of Wisconsin that's gonna vote on that so right all that people walkie-county is gonna get this we got we got white folks and people up north

and you're out west, okay? And the other thing will come on Mark Thomas, a friend of mine car got hit about a week ago. And the point was excellent to her. She said they put it in the back seat and told her we'll take her to the...

uh enterprise rental car because the insurance told her to give her a car he told her I'll take it out and she said you know you know you're a very nice person she said you probably shouldn't be in this business he said no that's why I'm in here he said I know there's a lot of cops and I'd do what they should do he says our job to make sure the citizens are well off and she had pulled over to the side the car was completely torn in the back but she moved over to the side and she told her and she keeps talking about it I'm not I'm so you know you need to contact that station and let them know and because that's how they get promoted I said that means the white guy she's an older black woman

took her down to enterprise with a car and got her, maybe since she got her car. Thank you for sharing that story. It's a good reminder. And you know, we know when we're talking that that does not apply to every officer. All right. So let me do this couple of quick things. And I got the call. I won't forget to talk about the Elon Musk piece.

Uh, so let me just do this real quickly. When you go to the ballot on November, I mean, when you go to the polls on November 3rd, you're going to see three constitutional amendment referendums. Okay. Um, if you have your mail in ballot, they're supposed to be mailed to homes by September 17th. So if you're someone who normally gets a mail in ballot, you should either have it already or it should be hitting your mailbox by September 17th. There will be three referendum questions.

AJR 10, AJR 102, and SJR 116. The A, the J, and the R stands for assembly joint resolution 10, assembly joint resolution 102, senate joint resolution 116. 102 is

the language says prohibits all government DEI programs and consideration of race, sex, or ethnicity in public employment, education, and contracting. Okay? So the minute that you understand that this prohibits, this is what it does. And I'm going to look and see the exact language, but they want to dismantle all equity programs.

to eliminate accountability for discrimination with this particular assembly joint resolution 102. 116 has to do with the partial veto of the governor. It would prevent the governor from using the partial veto to create or increase any tax or fee.

What folks are saying who want you to vote no is that it would permanently weaken executive checks shifts power to the legislature for partisan reasons. So Tony Evers goes in and, you know, make certain vetoes. I think like one where we end up doing like 400 years of public education with Republicans are hot. It's something that every governor in Wisconsin's history has had the ability to do.

and now all of a sudden Republicans, because all of these amendments were, uh, uh, amendment, uh, referendums were introduced by Republicans, all of them. So that ought to be the first clue that I need to look at it sideways. All three amendments were introduced by Republicans. Um, so what folks are saying who supported is it limits the governor's ability to raise taxes on their own and gives the legislature greater control over tax and fees.

There needs to be checks and balances, though. This is something we are unique in Wisconsin. It's only a few states that operate like this. And it has worked this whole time until Republicans no longer control the executive residence or the executive branch in terms of the governor's office. The other thing which I said is going to be the biggest sticking point.

is the resolution that would ban the government from closing places of worship during any state of emergency, including a pandemic. This particular referendum would change our state's constitution to say that the federal, I mean, I'm sorry, that the state government could never tell a church to close, even in a pandemic. One of the things

And the example that, you know, people have used I use as well because Republicans said, hey, that y'all let liquor store stay open. And, you know, they it's not that we more religious than anybody else in terms of being Republicans. You just try to play to the to the fears of people. And, you know, Bible thumpers, you ain't going after, you know, child molesters and pedophiles like, you know, the folks connected to Jeffrey Epstein, but we want to make sure that y'all can't ever touch our churches.

But this is the issue, the example that they use. A liquor store stayed open during COVID. Why did churches have to close? And this is what I say to people. When you go in the liquor store, how long are you in the liquor store? Particularly if it's not a holiday. Now, if it's a holiday, you might be in here about 15, 20 minutes. But for the most part, you go in, you get what you're going to get.

You might say hi to the cashier and you walk out that whole transaction is five to seven minutes When you go to church, how long are you at church? If you lucky You got the one hour church. Yeah, but even then if you're gonna be there, you know at the beginning

You're probably going to be here for about an hour and a half, 15 minutes before church start, go through the service for an hour, 15 minutes to shake hands, say by pastor, that was a great message choir. Y'all got down and leave. If you're at a different kind of church, you could be there two hours or three hours. I ain't going to call no names, but I have been to your church and I was there for three hours. In the course of those three hours, you singing, you praising,

You telling your neighbor. Uh, I wish my tail passes. People really get sick of y'all telling people to tell y'all neighbor. They do it, but.

Thank you sick of it. Well, that's another story for another show. Tell your name. Look at your name. I ain't come here and do no work. I came here to get this message and go home. There's plenty of GMB people. But the next time I come to New Berkeley, I'm wearing my tracks. I'm just saying it is. You can wear my Holy Redeemer too. But I'm just saying.

You, you spread germs everywhere. And so what people who have said, who don't support this is, I appreciate how important church was. Yeah. Yeah. And I appreciate being in person, but it's a greater health risk if you come. And so Michelle, the individual, not wearing no other hat, just my, my individual voice, we should be voting no on all of these.

But church people, y'all do y'all thing on AJR 10. That's your call. But nobody black and nobody that supports fairness should be voting for the ban on DEI. Nobody. Because it doesn't just include black people. It includes people in terms of ethnicity. It includes gender. Nobody should be supporting

AJR10102. Yes. You know what? I was just sitting here thinking as you was talking, you know what they're doing? They are really tying in, you know, with the stuff that they're trying to do low key, but they know that black people lean at the pin on their faith. So by tying in this whole church circuit, yeah, by, you know, leaving the church open. But then there's really underlying other stuff, but that they're tying in with that. So if you vote

Yes, to keep the churches open is really underlined for something else. Let me tell you something and you you dead on the money, bro When I tell you as I have watched more and more of our people in terms of the faith community Y'all slipping and y'all not paying attention And if you understand why you need to always think about that little white boy that came in there when the black folks was praying and ended up killing and shooting everybody. No, check this out. She'll hang out because what I'm saying is

The one stronghold where the civil rights emerges and gets most of his power and strength right is out of the black faith community and that's where I'm going because if you are really in your faith if You're reading the Bible the Bible tells you to watch and pray. Yeah, so that means Don't just spend all your time on your knees praying

That you don't see what's happening around you in your community when I tell you I applaud these pastors That are educating a parishioners about this upcoming election that they have opened a doors to allow people to give information Go get informed and educated yourself and do it yourself because this is not rocket science But I am watching a lot of our black people now become non-denominational. Yeah, I'm watching a lot of our black people You know

the way we're moving away from the political aspect of life.

And we're gonna leave it to the other people and you know I'ma let go and let God and da da da and I'm like y'all you can pray and serve Jesus and also go vote. You can pray and serve Jesus and also be politically astute and educated. You can pray and serve Jesus and be able to talk intelligently about what's happening in our community. You can pray and serve Jesus without being afraid that if you open your mouth somebody gonna come take your 501c3.

You can do it. Yeah, the NAACP Nationals model I'm not partisan, but I'm political as hell Yeah, you don't have to be partisan, but you need to be political because everything about your organization politics touches and Some of y'all y'all go up in here every Sunday you preach the same Basically the same sermon

And you are letting these people walk out of your church, not prepared to fully deal with this world. You got to talk about all of it. And so I am so glad that somebody asked the question about these referendums. Let me mention this Elon Musk thing before I get out of here. So many people know that we go to myvote.wi.gov when we try to get some information.

Okay, or vote.gov when you're trying to get some federal information. Elon Musk has created something. It is working with a group that has this thing called VoteSafe.org. VoteSafe.org. This organization, and it is a website run by America's PAC, which is Elon Musk Super PAC. Jake, can you get that door for me?

What they are doing is they act like they are checking your registration status, okay? Or you can use their website to check your registration status. The information they're collecting, first, middle, last name, date of birth, full home address, email address, cell phone number. But then your IP address and your location so that they can get your zip code, the internet provider you use, the time zone you in.

They want to know who your browser operating system is, so they're grabbing all of that when you go on their website. They even can tell what is the size of the screen that you are using to interface with this website. Every link that you click, every page that you look at, they are then able to see what you are doing on your device. They will then, you know, look at your voter registration status and your district and the ballot.

They begin to then send information to you to help try to sway you one way or the other. Do not use any website that you are checking voter information that reaches out to you. If it is called votesafe.org and let me make it as easy as possible. Official government websites got gov at the end. G O V. Not.

A whole bunch of stuff behind the GOV, just GOV.gov. If you see VoteSafe.org, that is Elon Musk, do not, do not, do not, do not put any of your information into this website. Please educate other people. And look at how they dress it up. VoteSafe.org.

It is information being harvested by the richest man in the world who is playing in races all over the world, elections all over the world to create this white supremacist order. Let's talk about those taxes and what are they going to do with them? They want to fund public education. How dare they?

Also, the other part of that is when you talk about the use of AI technology, geofencing, all of those things,

Remember when you walk me through the process of how they were able to look at who voted how? Yes in the 2020 election or the 2016 election, excuse me That has been amped up and people need to realize that they are being targeted with information based on their algorithms So yes, they will have something to say and oh you spent two hours at this place a church is right there So this person must be a Baptist this person must be church of God in Christ. That means they align with this particular policy

so we can feed them information to hopefully sway them and have them vote a certain way. So I think it's bigger than we're looking at a lot of times just at the surface level. So I am willing and able, and I know you would say the same thing, to go into some of these churches and talk to some of these pastors who don't really understand politics and what is happening to their congregations. It is more than just taxes, that's on the surface level. When you talk about how people are trying to geocache your church and look at your membership,

and try to peel back that layer of civil rights activity that we've always had in the black church. That's a deeper conversation. All right. Thank you. I appreciate it. Doc, I'm up against the clock. We had the opportunity when I say we, I mean, members of Delta Sigma Theta Sorority.

uh, social action committee members.

We had the opportunity to go over to the church and sit out in the vestibule and make sure that folks were registered to vote to give them information on the three upcoming, uh, amendments, constitutional amendments, uh, referendums that are on the ballot to make sure that

folks were informed and educated that they understood what those referendums did.

We were actually fortunate enough to have a few minutes to speak to the congregation.

And so to Pastor Avi and Pastor Avi, so funny both of them, Pastor Archie Avi, he's the Pastor Emeritus, and then to the younger brother that is now leading

You know, the congregation, Pastor Ivy, Mrs. Ivy, Archie Ivy's wife.

I had an opportunity to see her.

It was great to see her.

And then Debbie Ivy, my sorority sister, who is First Lady at the church now.

So it was just great.

We saw a ton of people, met a lot of listeners to the show, and had some really great interactions.

And I loved that everybody, just about that, we checked at the church.

They were good, you could tell.

was being pushed over there.

We did, we did have to do one new registration, help a young brother get registered.

And then there are a couple of people like addresses was off and we're telling people, look, there are folks that have said, you know, I still voted my own address.

Y'all cut that out.

Y'all cut that out.

Y'all cut that out.

That is illegal.

That's how we got a sister who was looking at jail time.

because she was voting at a different address.

Yes, I know she passed, but she was voting at a different address.

And that is something.

And when it comes to, you know, what people consider violations in terms of elections and how folks can handle it and prosecuted, it just looks real different for people of color.

So I'm telling you right now, if you need to get your registration in order in terms of your updating your

address information, you can go online and do this if you need to get your name in order.

So you got you recently got married or you got divorced, you went back to your maiden name.

If you got any issues and this primarily impacts women, if you got any issues going on with your names, take the time to go get those names in order.

But I'm going to just say this, we have not gone to a church yet in which we didn't end up helping somebody.

We have not gone to a church yet.

You know, and every people like, I'm good.

I'm registered.

I'm straight.

We had a sorority sister who came up at a meeting on Saturday and she said, look, I'm asking you to encourage people if you do not.

plan to vote by mail and ballot.

You're going to vote in person right up until the day of the election.

Please continue to check your voter registration status to make sure that nothing has happened with you being on the rolls.

We had two people, they were surprised.

They was like, no, I'm registered and I'm turning the screen around and saying that you're not.

So, let's figure out what's going on.

Let's just take care of it right now.

They went through, they entered all the information they needed to, and then they got the little thing on the screen saying you're registered.

So, this election is going to be critical and pivotal, and I just want to say that the church is in good hands over there.

I had an opportunity to hear a lot of discernment this morning, you know, and Pastor Meredith, Archie Ivy,

Pastor Ivy he looked good.

He looked well and You know, you can you can see the fight you can see the fight is always there and it's beautiful wife So I just want to say how much we appreciate it being able to go over there if you have a church faith group

And you would like us to come out and talk to your group to explain the referendums that's on the ballot to make sure that your folks are registered.

They have what they need.

Just call me and leave me a message here at the radio station.

We will come to Bible study.

We will come to church service and sit out in the vestibule and make sure people are good.

You know, I laugh.

We go back to when we were able to do it at Holy Redeemer.

as long as it's not Jermaine talking to that's exactly That's exactly what we do Well, it is good to see a lot going on it is so funny the number of times that

Different things will appear and you cross my mind literally.

I'm like, huh.

I wonder if I should ask about that So it is it is good to have you in house this morning our conversation we were talking about systemic issues and you know, I referenced that there had been a comment made by president

of the United States at the Republican midterm convention.

He brought up the issue of reparations and talked about how that, you know, we don't have the money to do that, that they're the people that want it are people that hate this country and that.

They could afford to do 5,000 per person, but they couldn't afford to do anything That would be required for reparations And these were crimes that the people of today didn't commit he did call them crimes, but And so you just begin to think about how entrenched certain things are and I talked about the fact that

in October Ava DuVernay who did the 13th project she now has a new project called the 14th and it is actually going to air on Netflix in December and so this morning when you said our conversation will touch on both the 4th and the 14th amendment I'm like okay I'm ready for this conversation so do me a favor mark tee up our conversation this morning

you know

So my name is Mark Thompson.

My firm is Jingress Thompson and Walks and I've been with this firm's nine years now, but I have been a lawyer since 1987 and For the first year worked at the 7th Circuit

which is the Court of Appeals before the US Supreme Court and sets the law in Wisconsin, Michigan and Illinois and The one thing that I've learned through this lifetime of reading cases and looking at the stories or the facts as we say that give rise to this

there is this wrestling within the courts over what is the fourth amendment and what does it protect and who does it protect and and that you know we talk about you cannot stop someone on the street law enforcement can't stop someone on the street

absent reasonable suspicion of a crime.

You can't search without a warrant in the home.

This idea of an individual having liberty every day.

It's the Fourth Amendment.

Fourteenth Amendment is equal protection.

And it comes out of the struggle of

the African-American people to find freedom after being treated as property.

And so when you say that we have a president who talks about reparations out of slavery for people who don't love the country,

It is so divisive and it's so untrue, right?

Because it is the African-American people have been the heart of democracy, the heart of voting rights, and every success and step forward for the African-American people has meant humanity has stepped forward.

And when you have a president that turns the world upside down with a lie, we know we're at this critical point.

We've spent a lot of time talking about, right, MAGA's movement, Steve Miller's movement to turn this country into,

a white power country and not a democracy where everyone is treated equally.

And so that's sort of the backdrop.

Tomorrow I go back to the Southern Circuit and I get to argue on behalf of pastors William and Patterson about why a federal judge here in the Eastern District got it wrong when

the judge dismissed their lawsuit.

So this is one of the things that I do that other lawyers in the business, personal injury business, I don't think necessarily do, or not as much as we do.

So I just want to touch on what happened.

May 1st, 2018, think about it.

That's like eight years ago.

They had been fishing.

And wait, but can I just do this because I want to just make sure so the community makes this connection So we're talking about the Reverend Demetrius Williams of community Baptist Church of Greater Milwaukee and Reverend John Patterson of Mount Olive Baptist Church So the community will have a point of reference because these are well-known individuals in the community.

Yes, they are okay and They've been out fishing

And on their way home, they're driving along I-94 coming back.

They're on the Rock River, so they're coming back.

And they're in Waukesha County.

And unfortunately, a tire on their boat trailer blew out, so they have a flat.

And they pulled way over off the road and way onto the shoulder.

And as soon as they got there,

Pastor Patterson called his insurance company said we got a flat.

They said, you know, we will send out a tow truck.

It'll be there very soon enough and so then they were waiting and as they were waiting a Waukesha County Sheriff's vehicle comes up behind them with the lights flashing and

they assumed that this was just sort of a caretaker function, right?

Our state troopers, our deputy sheriffs, our police officers, when they see a human being in distress and need, they come to help, right?

Serve and protect, right?

To serve means to help.

And the deputy

walked up to, uh, Pester Patterson's side.

He was driving.

He did not say hello.

He did not say, are you okay?

He just said, do you have guns?

Do you have drugs?

And first

thing out of his mouth,

first thing out of his mouth.

And Pastor Patterson looked and says, we're fishing and we're pastors.

What are you talking about?

And they says, give me your driver's license.

And he's like, why?

Why?

And then he demands that Pastor Williams, who's the passenger, give me your driver's license.

And Pastor Williams says,

You know, I'm I'm a passenger.

Why do you want my license and He walked around the car Got up right up the on the passenger side and and now he's looking at Pester Williams and he says I Have to have your driver's license.

He says why he says it's policy.

I have to have

driver's license and Pastor Williams is and Patterson thing look at this thing could completely escalate

right

and so they turn over his license but under protest and then the deputy goes back to the squad and all this time the lights are on right got the license 15 minutes later

Comes back gives them the drivers put the sticker on the car and drives off, but they ran a warrants check, right?

Right they ran the warrants check And so that's

a quick question So is that something like when you get my driver's license and you run that Does a warrant automatically show up or when you say ran a warrants check?

Is that a second procedure that you have to

do?

Well, they're running a procedure, right?

They're gonna put your name

your driver's license in to see if there are any outstanding warrants.

Right?

I mean, in it, you know, these cases all tied together.

We had a lot of discussions about Isaiah Taylor's case, right?

Young 16-year-old, young African-American running, taking a turkey to his neighbor's at Christmas.

Pull him over because they want to run a warrants check, right?

So the assumption is that this is not a reasonable sufficient of a crime, but a crime we're going to go get, you know, we're going to go check the warrants check.

So we find out it's any warrant and we can make this a rest.

The pastors said, look, you know, this isn't right.

They work with common ground and they tried to take it to the sheriff and, you know, like, let's use this as a teaching moment.

The sheriff Was non responsive In the course of this there was a white woman Susan hero who wrote a letter to the the sheriff and said look I Had the same thing happened to me in Walker Shaw except when the deputy came by they came up and just said hi How are you doing made sure I was okay was cold.

Let me sit in their car while

Right and so eventually the passers came to me and I said look we'll file a civil rights case and Let's go through it because this is when an officer comes as a caretaker function They don't have the right to take your license see

If it's a traffic stop, that means they have a reasonable suspicion that you violated the law.

Either you were speeding, right, or your license plate wasn't on, or you got tinted windows.

So at least there, there's a law, right, that says, creates this reasonable suspicion, even though we, we know how that can play out.

But, so here we have this case.

So it's caretaker there was no reason to ask anyone for their license insist on their license when they said why do you have to have them and We filed this lawsuit and we got into it and What we what we learned is that When when this deputy he had said that there was a policy it wasn't true Right because he was trained That if it's a caretaker function

You can't have you can't insist on taking the license and certainly you can't run a once-check and you certainly can't keep anybody there So that his supervisors said whatever story is is just not true Now part of our claim was not only that this violated Fourth Amendment

Hang on so we let me take a quick break and then we come back because I went back and pulled a story

And it also looks like that one of the officers was quote in training and there was a supervising officer or

we'll get to Yeah, because

I'm trying to figure out like so if this is happening and you're being trained But if the share policy is the shares

the Not in the approach to the deputy right the records that we found out were as they approached they knew the vehicle was completely off the road and this is sort of where the story that

Shifts as the deputy is being investigated You know, but but let's also go back to there was a we sued for racial profiling and a class of one equal protection claim with because this white woman Who happened to be a lawyer said look at this is not how I was treated Right and so and there are there's case law out there that says where

You're looking at a fourth amendment and their violations of the fourth amendment and that The violations of fourth amendment are linked to One's race race is a factor right and so we asserted that we had enough for a jury to decide violations of the fourth and 14th amendment and What was

really interesting in this is because the training officer first came out and said that the deputy's statement about a policy that he was following policy was not true, right?

That the Waukesha Sheriff's Department do not have a policy of insisting that drivers that are in road trouble, right?

Caretaker have to turn over their license Rather the policy is if you ask they can ask for it always, right?

But if you say no that then the officer must stop so that the officer should have never taken

But this is my first my question.

if the training officer You know because for me, it's not just enough for the training officers.

I know we never

Told him that there was this kind of policy, but you see this deputy sheriff running these Licenses and you see him take the license from the passenger.

So at what point?

Does the training officer say to this this officer that is in training?

What are you doing

and the training?

Comes up with a story saying there is

Right because then he started changing his story when he got back and he wrote he said The tire was not the boat wasn't completely off the roadway.

So now we have He knew enough about the law That he needed to make it a traffic stop not a caretaker function because if it's a traffic stop

if he had reasonable suspicion that the vehicle was on the roadway, not off the roadway, then he can ask for license and then he can run a warrants check.

His supervisor that I deposed and up the chain of command said, if they would have known that there were lies in the letter, because when I deposed officer deputy, he said his report.

Was a CYA letter.

That's what he said Right good when I because I said to him you knew the vehicle was off the roadway.

Yes, so when you wrote in your report that it was on the roadway That was a CYA and he said yes, so we knew he knew the difference Right and we knew that he didn't tell his super of his training officer the difference

But I'm still dying.

We took this to the federal judge and the federal judge three years after all the briefing ruled that the deputy didn't violate any rights and dismissed their

their cases.

And this is why I'm going back to Chicago

tomorrow.

It took the judge in this case three years to render a decision.

That's the fact.

So, but let me wrestle with.

is wrong with

this?

What happened?

Like justice delayed justice denied.

I mean three years

and that's why I said this is related.

This is related to mega and mega's lies.

Okay, because what we have that judges decision accepted the officers reasoning saying the officer believe

They had a reason to suspect that the vehicle was on the roadway.

So they had the right to do, run the license, run the warrants check.

And so that decision now becomes the legal infrastructure that sets the example.

That's where the law becomes part of the problem.

Right when the law Justifies this kind of conduct that allows Not allows it gives the green light For everybody to continue this conduct so now

is it that the law Sets up the situation for this type of conduct because if the law was being applied properly and the I'm just gonna say it and his deputy wasn't lying

then the law would have worked as design.

We're going to find out.

We always say

the laws are only

as good as the people who enforce them.

Right.

We're going to the Seventh Circuit and the Seventh Circuit.

We're going to ask the Seventh Circuit.

This is happening

tomorrow.

I'm going to ask the Seventh Circuit tomorrow to reverse the district court's decision because that decision can't be, right?

Because and here there are fundamental

when you look at an appeal, right?

What a judge can't decide on summary judgment is credibility.

And the law says the judge has to assume that the facts that we allege are true.

And if it creates factual disputes for a jury, then the jury must do

it.

But instead, the judge accepted the reasoning of the deputy.

Now, that is, in our mind,

illegal error that requires reversal but also stunningly what the what the judge said was that no one would reasonably believe that if a law enforcement officer pulled up behind you with their lights flashing that you couldn't just drive away

that's what

the federal judge said.

The federal judge didn't cite any case that said it, because everyone knows it's not true.

In every state in the Seventh Circuit, if an officer pulls up behind you with their lights flashing, you cannot move.

Because if you move, then you're a fleeing felon.

Right?

So this judge not only

violated the law and in our mind by accepting what the officer said is true as opposed to what the pastor said because that's a jury question but also came at it with a wrong legal theory made up out of the blue that no one in America would accept is true

key thing is the Seventh Circuit has to reverse this.

And that's the question I'm getting ready to pose is, so what kind of timeframe are we on?

I mean, if it took three years to get a decision from this judge here in Wisconsin, you go back, you ask the court to consider a reversal, how long does something like that take?

Or can it take?

That's a very good question.

Generally,

a decision from the Seventh Circuit.

It's probably six to nine months.

It can be a year and a half.

I have a case right now that I'm almost at three years waiting for a decision.

So there are all sorts of issues with justice in America, right?

Not only bias,

Right But I to me the point is and we say it every time Nothing will change unless people stand up and say end it Right if you just are sitting at home thinking it's just gonna get right if I just sit here and keep chewing my bubblegum it ain't happening Okay

If pastors William and Patterson didn't say enough is enough.

We wouldn't be here going to the 7th Circuit and say, look, this can't be right.

You cannot let.

You know, it's the jury decides these things at the end of the day.

And also, you know, just to be as far as I'm concerned, just candid and honest about it, having attorneys willing to take these cases.

Because so many times we get phone calls to this radio station, and this is before you and I begin doing this segment.

And we tell people, no, take it to it.

And the number of people say, no one will take my case.

No one will take my case.

I don't know if it's because people can foresee down how long these things can take to process, particularly if it's on contingency.

So lawyers are doing all this upfront work and not getting paid.

And you're talking about three and five years in, like this is the worst.

You know, there is sort of this notion that little harms don't deserve justice, right?

Isaiah Taylor was held in the car five minutes.

Everybody said, so what?

It's a 16 year old kid, so what?

Right?

But the seven circuit said, even one second is too long.

So we get to cite that in this case, right?

They said, what, it's 15 minutes we had there, license we ran a warrant check, so what?

Wait a minute.
