
Jim Santelle joins the show to talk legal issues! The central legal concept that had John and Gordy so wound up is the Non-Delegation Doctrine, which is basically the Supreme Court's way of saying, "Hey, stick to your lane, buddy!" The Constitution clearly gives Congress (Article I) the power to do boring stuff like tax people and manage commerce, but the Non-Delegation Doctrine says Congress is not allowed to outsource this job to the President. When the President decided to slap massive tariffs on everything, he was essentially trying to be the CEO and the Board of Directors, which is a big constitutional no-no.
The entire Supreme Court argument was essentially a three-hour constitutional time-out, asking whether Congress gave the President a blank check, or, in this case, a vague emergency law (the IEEPA) that he tried to use as a legal hall pass.
